Copyright, trademark and intellectual property law is an intricate area of law relating to the protection of literary, dramatic, musical, artistic and other works. Intellectual property is of significant importance and is often highly valued. Our intellectual property work is focused, most of the time, on technology issues. For example, we regularly draft and negotiate software licence agreements pertaining to the licensing of intellectual property in custom made industrial software, smartphone applications (such as, applications for the Apple iPhone, iPad and iPod Touch) and other software. We are familiar with exclusive distribution arrangements for the use of corporate branding in a particular territory, the registration of trademarks and dealing with trade mark disputes. Our lawyers are also experienced in resolving intellectual property disputes relating to the licensing of trademarks, the transfer and assignment of intellectual property in IT assets, as well as domain name, employment and confidentiality disputes.

Some examples of matters we have advised on and been involved in that relate to intellectual property include:

  • acting for a software developer in the settlement of a dispute with a large corporate group customer in the transport industry;
  • advising a multinational corporation on the assignment of technology assets and restructuring issues;
  • acting for a software developer in the settlement of an intellectual property dispute with an aggressive customer;
  • effectively defending and settling a domain name dispute with a foreign government body resulting in the domain name registrant client being paid significantly for rights to the domain name;
  • advising a client on a back-to-back software services supply arrangement with a foreign bank;
  • advising a technology importer on the distribution and resale of technology to the Australian Government;
  • advising a US headquartered client on the licensing of intellectual property to an Australian company;
  • defending an employee accused of misappropriating company trade secrets.
